The terms and conditions stated below apply to any individual / group / company / association etc making a booking to charter with our companies Asia Surf Charters Pty Ltd / Pt Saudara Samudera Sentosa trading as Asia Surf Charters Sumatra.
Travel Insurance
TRAVEL INSURANCE IS COMPULSORY! and must include a MediEvac option in case of any emergency situations. It is recommended that travel insurance be taken out at the time you make the first deposit. A copy of your travel insurance policy must be included when making your final payment.
Deposits and Payments
For bookings you are required to make a deposit to lock in your spot, final payment is due 10 weeks before departure date.

A non-refundable deposit of $750 AUD per person is due at the time of booking.

Boat charters are operations for which space is limited and competitive. Any cancellation made by a client will result in the forfeit of all payments.

The complete deposit is non-refundable.

The company does not grant refunds for any reason on or after final payments have been paid. Travel Insurance will usually cover any cancellations due to non-pre-existing medical reasons of yourself and immediate family.

There are no refunds or partial refunds given for early departures from boat charters. Early departures due to non-pre-existing medical reasons will usually be covered by travel insurance. No monies whatsoever will be refunded for reasons pertaining to poor surf or inclement weather.

No monies will be refunded whatsoever for reasons pertaining to global, national, or regional political situations (terrorism, war, etc) in the specific region. Acts of God: The company will not be liable for any losses, costs or delays resulting from tsunami, earthquakes, extreme weather. Force Majeure: The company will not be liable for any losses or costs or delay in, change to or cancellation of trips due to Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of the company and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, pandemic (including any such future circumstances relating to the known COVID-19 pandemic), industrial or nuclear disaster, adverse weather conditions, government travel bans, fires, and strikes.
LIABILITY

While our company & staff takes all necessary care and safety measures to run a charter all passengers and clients agree that in no way the owners, operators, employees, and agents are liable for any consequential damages. The operators of Asia Surf Charters Sumatra assume no liability for personal injury of any kind, death, property damage or theft (traveling to/from the boat and whilst on board), delays due to weather, airline arrival/departure times, acts of God, loss/late arrival of surfboards, surfboard bags or luggage, or any other event we are unable to control.

The owners/operators assume no liability to take out insurance for passengers coming on board Km Asia.

The owners and operators, agents, or employees of Asia Surf Charters Sumatra / Asia Surf Charters Pty Ltd / Pt Saudara Samudera Sentosa assume no responsibility or liability for costs incurred from injury or death, loss or damage to person or property in connection to any service we provide.

Illegal substances are forbidden and not tolerated on board Km Asia.

The captain reserves the right to remove any passengers from Km Asia that endangers the well-being and safety of the vessel, its passengers or crew, in accordance with Maritime Law.

It is the responsibility of all guests to check their passports, passports must be valid for at least 6 months from the date of entry into Indonesia.

It is the responsibility of all guests to obtain necessary VISAS – VOA (visa on arrival) or any other travel documents that may be required at the time of travel.
As a guest with Asia Surf Charters Sumatra, I acknowledge and agree:
That being a guest or passenger on a boat, vessel as a surfer, snorkeler, diver etc or engaging in surfing, swimming, snorkelling, diving activities, boat use, equipment use and/or other water sports (hereinafter referred to as the Activities) are inherently potentially hazardous, risky, and dangerous activities and involve the possible risk of property damage and/or serious injury and/or death.
That the Activities are physically strenuous, and I will be exerting myself. I am aware of the dangers of surfing, snorkelling, breath-holding while engaging in diving activities and will not hold releasees responsible for any and all of such injuries I may receive as a result of preforming these activities. On this boat charter, I will be at remote locations and there may be no immediate medical care available to me and I expressly assume the risk of engaging in the activities in such remote locations.
That any and all such injuries received may be compounded or increased by, negligent rescue operations, or procedures, of the releasees, or others, and I agree that this Waiver Agreement extends to all acts of negligence by releasees including, but not limited to negligent rescue operations and is intended to be as broad and inclusive as permitted by the laws governing the Province or State or Country in which the activities are conducted.
That if I engage in snorkelling or diving activities, that I will inspect my equipment prior to engaging in the activities and that I will notify a crew member if any of the equipment is not working properly. I will not hold Asia Surf Charters Sumatra responsible for any injuries received as a result of my failure to inspect the equipment and/or to notify a crew member of any equipment that is not working properly prior to engaging in the activity.
That Asia Surf Charters Sumatra reserves the right to provide a substitute vessel should the booked vessel be unavailable for any reason.
That Asia Surf Charters Sumatra may, if certain situations arise that, in their sole and absolute discretion, make it necessary to cancel, change, advance, substitute or postpone any scheduled departures and returns to port and do not assume any responsibility or liability for any losses, damages or inconvenience incurred by the guest or passenger as a result of any of the foregoing.
That I am physically and mentally fit to engage in the surf charter and fully understand the risks involved surfing in remote areas.
That I understand I have given up substantial rights by acknowledging the conditions of this document. I am aware of its legal consequences, and have signed it freely and voluntarily, without any inducement, assurance, or guarantee being made to me. I intend my acknowledging the conditions to be a complete and unconditional release of all liability, to the greatest extent allowed by law.
That by way of deposit payment I’m executing this Waiver Agreement. That I accept the terms and conditions of the waiver agreement and the details as stated in this document. That I am not relying upon any verbal or written representations or statements made by Asia Surf Charters Sumatra, or others, except as what is set forth in this waiver Agreement.
